Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) apply between Simflexity AB, org. No. 559332-7835 (“Simflexity”), and you as a user of the Simflexity platform (the “Platform”).

By using the Platform, you agree to comply with these Terms. The Terms include our Privacy Policy and Cookie Policy, which are available on the Platform under General Terms and Conditions.

If you do not agree to these Terms, you should not use the Platform.

2. Membership and Registration

2.1 Who Can Register?

Both companies and individuals can register on Simflexity.

  • Companies can register to post gig assignments and hire workers.
  • Workers can register to apply for gigs.
  • You must be at least 18 years old (or have a parent’s approval) to register as an individual.

By registering, you certify that the information provided is accurate and that you have the authority to create an account.

2.2 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify Simflexity immediately if you suspect unauthorized access to your account.

Simflexity reserves the right to request additional information or deny registration if we detect policy violations.

3. Platform Services

When you are logged into Simflexity, you can:

  • Companies: Post gigs, hire workers, and purchase additional services.
  • Workers: Search and apply for gigs, report time, and receive payments.

By using the Platform, you agree to adhere to all applicable policies.

4. Advertising Policy

This Advertising Policy is part of the Terms and Conditions and applies to all gig advertisements posted on the Platform.

4.1 General Advertising Rules

By posting a gig, you agree that:

  • The gig will be visible on the Platform upon registration.
  • Simflexity may modify the ad (e.g., resize images, reformat content) to ensure compatibility.
  • Simflexity is not obligated to display any ad.

4.2 Content Responsibility

The user posting a gig is responsible for ensuring that:

  • The information is accurate and not misleading.
  • You have the necessary copyrights, trademarks, or licenses for any content you upload.
  • The ad does not contain offensive or illegal material.
  • The gig is serious and market-based.

Ads that are solely for marketing purposes without a genuine job offer are not allowed.

4.3 Right to Remove Ads

Simflexity reserves the right to remove or deny any advertisement that:

  • Violates Simflexity’s policies, laws, or ethical standards.
  • Has been posted by users who have previously breached our Terms.

5. Fees and Payments

5.1 Gig Payments

After a worker completes a gig and the employer approves it:

  • Payments are processed via Bank Transfer or Swish.
  • The hourly wage includes holiday pay.
  • Simflexity is responsible for declaring taxes for the worker.

5.2 Service Fees

Simflexity may charge fees for services offered on the Platform.

  • Any applicable fees will be displayed before purchase.
  • Fees are non-refundable unless otherwise stated.

6. Intellectual Property Rights

All intellectual property rights related to the Platform, including its design, content, and technology, belong to Simflexity or its licensors.

You may not:

  • Copy, distribute, or modify content from the Platform without written permission.
  • Use the Platform’s services in a way that violates Simflexity’s rights.

7. Privacy and Data Protection

Simflexity processes personal data in accordance with GDPR. By registering and using the Platform, you consent to our Privacy Policy.

8. Cookie Policy

Simflexity uses cookies to:

  • Improve user experience.
  • Analyze site performance.
  • Personalize content and ads.

9. Limitation of Liability

  • Simflexity does not guarantee that the Platform will always be available or error-free.
  • Simflexity is not responsible for errors in gig advertisements, non-fulfilled assignments, or disputes between users.
  • Users are responsible for complying with all legal requirements in their country.
  • Simflexity shall not be liable for indirect damages, loss of income, or business interruptions due to Platform usage.

10. Termination of Membership

Simflexity may terminate or suspend a user’s account if:

  • The user violates the Terms.
  • The user fails to fulfill obligations (e.g., unpaid fees, fraudulent behavior).
  • The user engages in activities that compete with Simflexity.

A terminated user loses access to the Platform and any associated services.

11. Transfer of Rights

Simflexity has the right to:

  • Transfer its rights and obligations to another company within the same group.
  • Assign its rights to a third party, provided that the new owner can fulfill Simflexity’s obligations.

Users cannot transfer their accounts without Simflexity’s prior approval.

12. Dispute Resolution and Governing Law

  • These Terms shall be governed by Swedish law.
  • Any dispute shall be settled in a general court in Sweden.
